TERMS AND CONDITIONS

These MyReidHealth Access Terms and Conditions contained herein (“Terms and Conditions”) shall govern your use of the MyReidHealth services and system. We offer MyReidHealth access to you conditioned on your acceptance of these Terms and Conditions. By clicking on “Accept”, you accept without modification all of these Terms and Conditions and acknowledge and agree that these Terms and Conditions are a binding agreement between you and us. If you do not agree to these Terms and Conditions, you must decline them and not use MyReidHealth.

The use of the words “we,” “our,” and “us” herein shall mean Reid Health, and the provider practices, hospitals, and independent health care providers that are connected to Reid Health’s electronic medical records system.

In consideration of your agreement to these Terms and Conditions and for other valuable consideration, we grant to you a nonexclusive, nontransferable, limited, terminable license to access and use MyReidHealth only in the United States. We reserve all rights not expressly granted in these Terms and Conditions.

To improve our ability to serve you, we may make modifications, improvements, deletions, or amendments to the MyReidHealth system at any time we deem appropriate. Any and all relevant portions of this agreement will apply automatically to all modifications, improvements, deletions, and/or amendments as they appear.

What is MyReidHealth
MyReidHealth is a communication service offered as a convenience to our patients and their families. It is an Internet application that enables patients to have web-based access to portions of the electronic medical record that we maintain, and allows a convenient communication channel with certain providers for non-urgent messages. There is no charge for general access and use of MyReidHealth. Fees may apply to certain other features and there will be a notice of acceptance of any fee prior to use. MyReidHealth is NOT for medical emergencies – for emergencies, please contact your provider’s office by phone, go to an emergency room, or dial 911.

The MyReidHealth record may not be a complete copy of your patient medical record. You may obtain a complete copy of your medical record by contacting your provider, the Health Information Management Department or submitting a records request in MyReidHealth.

You understand that MyReidHealth provides online access to portions of your medical record and that you are solely responsible for any sharing of its content that you intentionally or unintentionally communicate to others. You understand that messages will be routed to the appropriate department as necessary for handling, and therefore, our employees, other than your healthcare provider may be involved in addressing your request. Therefore, use of MyReidHealth may, in your mind, not be appropriate for very sensitive information you wish to discuss directly with your provider. In such circumstances where you desire to only share such information with your healthcare provider, it is your sole responsibility to ensure such information is not included in your messages being sent through MyReidHealth. Electronic messages sent by you and responses from health care providers will be retained in the MyReidHealth system.

Who Can Use MyReidHealth
MyReidHealth is available to individuals age 14 and older. By applying for access to MyReidHealth, you represent and warrant that you are at least 14 years of age. Additionally, you agree to be responsible for: (1) maintaining the confidentiality of your password, and for all activities that occur under your password; (2) prohibiting anyone else from using your password; and (3) limiting access to your computer or the Internet to the extent necessary to restrict access to your MyReidHealth account; provided, however, you may authorize another person (such as a family member) to access your MyReidHealth account as outlined in the "Proxy Access" section below.

Proxy Access
You may authorize proxy access within MyReidHealth. Proxy access allows another person to view and have access to your MyReidHealth account. You may grant full or limited proxy access to another person and you may terminate the access at any time (unless the individual can demonstrate legal rights to your account as described below). All individuals receiving proxy access must comply with these Terms and Conditions.

Full MyReidHealth proxy access is available for parents or legal guardians of children up to age 14 but limited between the ages of 14 and 17 (unless a child separately authorizes a parent or guardian to have full proxy access during this time period). A MyReidHealth account will be activated for both the proxy and the minor account holder.

Proxy access may be requested by individuals with legal rights over the MyReidHealth patient/account holder but only to the extent that the individual requesting proxy access can demonstrate the legal right to the account holder’s medical information. If a provider determines a patient does not have medical decision-making capacity, an appropriate surrogate (i.e., Power of Attorney for Health Care, Health Care Representative, Court appointed legal guardian, or other surrogate under Indiana State law) may request and be granted full access to a patient’s MyReidHealth account; provided, any legal relationships must be supported by providing a copy of the legal document verifying the surrogate’s authority to have access to the patient's medical information. Proxies of diminished capacity/incapacitated patients are eligible to participate in the full spectrum of MyReidHealth services on behalf of the patient.

If a proxy’s legal relationship with the account holder changes, the proxy must inform us immediately by calling the MyReidHealth Support line at (317) 355-2273. We reserve the right to revoke proxy access at any time for any reason.

Services
We will use reasonable efforts to provide a timely response to electronic messages. While the anticipated turnaround time is two (2) business days during normal office hours, this is only an estimate and not a binding a commitment. Thus, if you determine a more urgent response is necessary, it is your responsibility to follow up and/or schedule an appointment if warranted. At this time, the following services are available through MyReidHealth:

  • Ability to review, make or cancel appointments
  • Ability to view selected portions of your medical record such as allergies, medications, histories, problem list and recent visit information
  • Ability to receive selected lab results
  • Communicate with your health care provider via messaging regarding non-urgent health concerns
  • Request prescription refills
  • Access patient education materials and links to other sites from time to time that will provide you with health information
  • Request a copy of your medical record

Other services may be added by us from time to time.

Privacy
We will, at all times, use reasonable efforts to maintain the confidentiality of your confidential medical information and will not disclose any such information to any unaffiliated third party unless you authorize that person to receive your information or the information is permitted to be disclosed by law. All messages sent and received within MyReidHealth that contain medical information are subject to all state and federal laws governing the security and confidentiality of medical records. Please read your provider’s Notice of Privacy Practices for more information on how your medical information will be maintained.

Password
When you initially enroll in MyReidHealth, you will be provided with an access or activation code. The access code you receive will give you the opportunity to create a personal login name (called “MyReidHealth ID”) and a password. Once this access code has been used it will no longer be valid. If you do not have an access code, you can still register for a MyReidHealth account online. You will go through an identity verification process and thereafter you will be provided the opportunity to create your MyReidHealth ID and password. It is extremely important that you keep your MyReidHealth ID and password completely confidential. Anyone with access to your MyReidHealth ID and password will be able to access your confidential medical information. That person will also be able to read your messages and send new messages as if they were you. It is your responsibility to prevent disclosure of your MyReidHealth ID and password, and to change your password if you feel that your security has been compromised. Your password is only known by you and can be changed online at any time by you. Your password is not known by us. It is recommended that you change your password every 180 days.

Communications
Based on the preferences you select in MyReidHealth, you will receive notifications via e-mail when there is new information to be viewed in your MyReidHealth account. This means that any person with access to your e-mail will be able to see this notification; this could include your spouse, employer or anyone else that can access your e-mail account. Although no private medical information will be sent via e-mail, the notification that new medical information is available by accessing MyReidHealth may be information that you would not want others to know. Thus, you should take into account who has access to your e-mail address when providing an e-mail address for such notices to be sent.

Firewalls, passwords, encryption and other periodic quality oversight activities are used to safeguard your information and the communications between you and us through MyReidHealth (the “Security Measures”). While such Security Measures are used, you agree that we shall not be liable for the failure of such Security Measures unless such failure is due to our gross negligence or willful misconduct

Appropriate Use
Access to MyReidHealth is granted to users for their convenience and to share information related to their medical care. Your use of the system unrelated to this purpose may result in the suspension or termination of your access privileges. Improper activities include, but are not limited to, the use of inappropriate or abusive language, reserving appointment times that are not needed or are frequently cancelled, repeated attempts to communicate with a provider who has severed the provider/patient relationship and other activities that are deemed to cause a disruption to clinic operations in our sole discretion.

You agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the registration form (the “Registration Data”) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the MyReidHealth services (or any portion thereof).

If your use of MyReidHealth violates these Terms and Conditions, we reserve the right to restrict or permanently terminate your access to MyReidHealth.

You can disenroll from your use of MyReidHealth at any time by calling the MyReidHealth Support Line at (317) 355-2273.

Connection to Third Party Devices and Application
You may connect certain third party devices or applications (“Third Party Apps”) to MyReidHealth to share your health information in MyReidHealth. The connection can only occur with your permission and by your actions in MyReidHealth. We do not endorse any Third Party Apps and we will not share your personal medical information with any Third Party Apps. We do not manage or control the security and privacy of Third Party Apps. It is your responsibility to determine whether these devices and applications meet your security and privacy needs, and you should determine how these sites secure your data before you connect the Third Party App to MyReidHealth.  We reserve the right to disable the connection to any Third Party App if needed.

To send your health information from certain Third Party Apps (for example, Apple Health, Google Fit, etc.) to MyReidHealth, you must obtain an order from your provider. Once your provider submits the order, you may connect your MyReidHealth account to the Third Party App to share information from the App with your healthcare providers.Please note that your information sent from Third Party Apps to MyReidHealth will not be reviewed immediately by your provider. If you are concerned with a reading from a Third Party App, please call your provider immediately. MyReidHealth is not an appropriate method to communicate urgent information.

Disclaimer
With respect to any electronic communications you send, your health care provider is only able to respond to such communications based on the information you have provided. If there is insufficient information provided or an appointment is needed, your health care provider will be unable to provide accurate and reliable services through MyReidHealth. We assume no responsibility for how you use the information you obtain from MyReidHealth. You should consult with a provider or other health care provider regarding your own condition and how the information in MyReidHealth applies to you. MyReidHealth access is not a substitute for consultation with your provider and MyReidHealth does not include your entire medical record. You should never change or stop any course of treatment prescribed by your provider without first consulting him or her.

We may restrict or terminate access to MyReidHealth at any time, including, but not limited to times, where maintenance of the MyReidHealth system is needed or you have violated these Terms and Conditions. Access is provided on an “as is available” basis and you agree that access is not guaranteed at any particular time. You agree that we shall not be liable to you for any modification, suspension or discontinuance of the MyReidHealth services (or any part thereof).

You agree to hold us harmless should any information be lost while communicating online or if any information is disclosed to any other individual communicating with us using your MyReidHealth account.

THE MYREIDHEALTH SERVICES AND SYSTEM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE AND OUR SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE MAKE NO WARRANTY OR REPRESENTATION THAT (a) THE MYREIDHEALTH SERVICES OR SYSTEM WILL MEET YOUR REQUIREMENTS; OR (b) THE MYREIDHEALTH SERVICES OR SYSTEM WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT WE AND OUR SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE TO YOU FOR ANY PUNITIVE, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE MYREIDHEALTH SERVICES AND SYSTEM; (ii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OF DATA THROUGH THE MYREIDHEALTH SERVICES AND SYSTEM DUE TO NO FAULT OF US; OR (iii) STATEMENTS MADE BY, CONDUCT OF, OR ANY INFORMATION, SERVICES OR GOODS PROVIDED BY A THIRD PARTY.

Links and Third Party Information
We, through MyReidHealth, may provide, or third parties may provide, links to other World Wide Web sites or resources. You acknowledge and agree that we are not responsible for the availability of such sites or resources, and do not endorse and are not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

Governance
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Indiana without regard to its conflict of law provisions and any dispute, claims or causes of action (regardless of theory) arising out of or relating to these Terms of Conditions or the relationship between you and us shall be exclusively brought and exclusively maintained in a federal or state court with competent jurisdiction in Wayne County, Indiana. You agree to submit to the personal jurisdiction of courts located within Wayne County, Indiana and agree to waive any and all objection to the exercise of jurisdiction over you by such courts and to venue in such courts.

These Terms and Conditions constitute the entire agreement between you and us and govern your use of the MyReidHealth services. Our failure to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms and Conditions shall remain in full force and effect. We may update these Terms and Conditions from time to time. The current Terms and Conditions will be posted and available on the MyReidHealth web site. Your continued use of MyReidHealth is acceptance of any updated changes to the Terms and Conditions.

These Terms and Conditions are effective until terminated by either you or us. We may terminate these Terms and Conditions, with or without advance notice.

BY USING MYREIDHEALTH AND CLICKING ON ACCEPT, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND REPRESENT THAT YOU HAVE READ AND UNDERSTOOD ALL OF THESE TERMS AND CONDITIONS.
